Good day, I would like to know, my wife and I are divorcing and I file for divorce as she cheated but on the settlement agreement I dicided that she must get half of my pension as she does not have one and half of the thing in the house we are renting, but she refused saying I must not get anything from the house so I must start all over with nothing as I did before on my first divorce. We don’t have any children with her.

Hi, my husband and bought land in one of the rural land reforms. We bought the land from the traditional leaders,  obviously we didn’t get a title deed. We decided to build a house on the land. Now we are dirvocing and i wanted us to sell the property and share the money as we are married in community of property. My husband refuses to that and i also want to know if it is possible for us to sell this property since its under traditional leaders. I have invested too much on this house, i cant just walk away with nothing, i used up all my retirement funds to build thid house.

Hi there, I have several question that I need to ask in relation to divorce process and division of the estates including our liabilities.

We have one child together.

I have a property in my name and my deceased husband and still owning a bond

He has a house under his name still owing a bond

I have a car in my name still owning.

He has a car under his name still owing 

Both have government pension funds

Both accumulated debts while in this marriage 

He buys me grocery every month, pays the helper where I stay, pays gardener where I stay, pays the swimming pool guy for all maintenance.

From 2015, his been staying in Port Elizabeth in a state house and I’m staying in his house in Gauteng.

We have households for the property we staying in.

We married in customary law in 2004 and it was celebrated by both families. But our marriage was not registered with home affairs.

We have 1 child together she’s 14 years, staying at hostel in port Elizabeth, his the one maintaining the child in everything.

My questions are

What will be the process to resolve this type of marriage.
